This report was commissioned by the Task Force on Housing, Land and Property (HLP) of the Internally Displaced Persons (IDP) Protection working group. It aims to look at the problems faced by IDPs and returnees in accessing their land related rights and entitlements. Ownership of land is central to sustainable and durable solutions to displacement both in terms of security of tenure and livelihoods. By looking at existing studies, this report seeks to identify the issues that remain relevant in post-conflict Sri Lanka and further identify new and pressing issues that have emerged. Furthermore, the existing legal framework relating to HLP rights and entitlements seeks to identify instances where policy and law need to evolve to ensure that HLP related right of IDPs and returnees are realized and protected. The main aim of this report therefore, is to provide an informative framework to stakeholders working in the area of HLP rights as well as to inform their programmatic responses. In this light, the report identifies a number of recommendations necessary to ensure that the HLP rights of IDPs and returnees in the North and East are upheld in a uniform and just manner.
